A way to break loose from the present expensive patent-and-sue system of idea territory control

To get around the problem of patents and lawsuits effectively strangling new creative technological ideas for new American products, instead of the patent-and-sue system we now have for combat between individuals and companies, how about making it like the interstate highway system, a governmental and unbiased system for rewarding originators of the ideas and products based on those ideas, so that all technological patentable ideas are freely useful by all Americans in their products.

The compensation to the originators - and which could be secondary inventors too, anyone independently coming up with an idea even if already someone else had previously done that somewhere - according to a share of the amount of application of the idea in American technology products.

It would be paid for by a general tax as a fraction of the sale price of all technology products, without regard to which technological ideas or patents were involved in their creation and manufacture.

This is justified because probably all but the latest bit of an idea for technological innovation, is actually built on all the technological, scientific, engineering ideas developed and made available throughout civilization's growth, probably going back to the Greek scholars and even to the stone hatchet or even the invention of tamed fire for cooking.

The benefit of such a system is expected to be the unfettering of idea makers and manufacturers and technological product developers, so they can rapidly proceed with the implementation of their products and ideas for products. No need for a massive expensive legal department to root in the patent stuff to find which ideas can be pursued in a new product, which is something important for the backyard lone inventor, especially.

For example, let's say that Apple comes up with a new patentable idea. The idea is disclosed in the patent and registered with the patent office. From then on, everybody can freely use that idea in their inventions and products. Apple would get compensated for their invention by an appropriate portion of the taxes collected during the sale of technological products.

This would enable rapid building upon new ideas of others; more importantly, it would enable creation and development of new ideas and innovative products, without the hassle of wondering if someone else had thought of parts of it before, and would act to block the new product. It would also stop the technology-strangling business practice of patenting some key part of a technology, with no intent of using it in a product, but simply to prevent it from being used by a rival business; thus, more kinds of products would become available to the customers, expanding the functionality of the nation.

Opponents to this concept, I fantasize, would be those who derive fame&fortune off of the existing patent-and-sue system; those who consider their patent base as a means of control rather than just financial gain; those who would find it disturbing because it is not the way they are familiar with doing things or thinking about things; and the conservative political group who want less governmental influence and fewer taxes; this makes sense insofar as the risk of some political group getting itself into office who are in it for power and control by a mere few Americans, for their own exclusive benefit. Liberal politicals would question how could privateering such a system be made unbiased and unrestrictive by whoever was controlling it all. Then the costs of paying for it out of detailed tracking of which patent, which idea and in which proportion of each new product, would be overwhelmingly costly and time consuming, almost as bad as the present system and probably even more expensive. So it seems best to me to have it as stated above, paid for by a general tax on all technological based products, from toothpaste to jet aircraft. Even agricultural products depend a lot of technology for their products, such as tractors and fertilizers.

Such a system would be of great benefit in teh upcoming expansion of civilization into nearby space. Although much of teh technology being utilized by upcoming corporations, such as launch vehicle technology, was developed by NASA and therefore paid by American taxes and therefore free to use, newer space access & utilization technologies could be hamstrung by trickery use of the patent-and-sue system by those who patent some key part of a new upcoming technology, with no intent tu use it for goods or services, but merely to prevent rival ways of accomplishing needed things, from being utilized. Much of the space industries are solely based on gaining profit and have little intrinsic interest in the unbiased expansion of civilization into the resources of nearby space, and thus are likely to prevent American best approaches to space, if that is the way they gain most power and wealth.

This proposed system would also wipe out purpose from the often abusive corporate practice of the unrighteous application of the so-called "employment agreement" ceding all ideas by the prospective employee in the future to the employer, regardless of the employer having any intent to utilize the ideas of the employees. This has been blocking the nation's utilization of the vast majority of technologically-interested workers, people who are hands-on in technology and often get new ideas simply by the stimulation thereby of the technological creative part of the mind not involved with the performance of the job for which they are hired to do, which insight can inspire any time of day or night, on or off the job, and most of the time have nothing to do with their fulfillment of their hired-for job accomplishments.

By adopting the system proposed here, technological product advancement could be gotten out of the virtual exclusive control by wealthy companies, and back into the hands of the independent inventors and developers, including small businesses and backyard inventors, where currently most ideas have to die in the present expensive patent-and-sue system of idea control. All would ultimately benefit, from the huge wealthy corporations to the backyard lone innovators, insofar as contributing to the technological capability of the nation.

(Nonetheless I expect this concept to be deep-sixed, because "it is not how we do things, and we are the ones in control here, not you." The place is crawling with bullies.)

Waking up and getting responsible to our nation

The announcement of a probable credit downgrade for the nation ought to be arousing folks in DC. That is assuming that what has been going on is not a methodical takedown of the nation as part of some big takeover of the nation by a few of the ultra-wealthy. Ignoring that hopefully paranoidish view, it then suggests that the nation needs to get busy and do something about the problem.

America needs to get all its people back into the productive mode. Waiting for corporations to provide the jobs clearly is not working at all; the corporations are ruled by the bottom line and that often means they have the work done offshore as they can do it cheaper there, and so the task of getting all American back into being productive, is not being fulfilled; expecting to give tax breaks for corporations and then magically that translate into American jobs has not worked and can't be expected to work, because the corporate "law" that demands they only do what makes the most profit for themselves. And any CEO deciding otherwise will probably get the boot from the shareholders, unfortunately an inherent weakness in our system.

We need to act as a nation on this matter. Think as a nation, not as a pack of isolated businesses all grabbing for a bigger piece of the increasingly non-existent pie. That is part of American government's duty ... government is not there just to provide for the common defense, but also to enable the nation to function as a thriving whole.

So, how to get the mode of America to shift from the current mode of being a big gambler's game that increasingly piles all the wealth up into the hands of a few expert gamblers that play the system - who are not necessarily guided by responsibility for the system of human and natural resources that enables that wealth to happen.

Clearly, that which makes the most money for someone, is not at all necessarily the same thing as what best meets all the customer's needs. It might be; but not inherently be. In this case, the customer is the American people, rich and poor alike.

Even the health system has grown to be guided by what makes the most profit for the health industries, and competition opportunities is heavily blocked by what effectively is business territories, some of which are even backed by government enforcers, a real mess in places. There are health modes that are being completely ignored because they do not make the big money for the health businesses already in place. And the current health systems states are merely one example of what has happened to our country.

We are a fairly intelligent people. And we are increasingly able to access a bigger set of knowledge, via the internet and our computers and smart phones. So we have lots of potential. Figuring out what to constructively do with that knowledge for the betterment of us all as a nation, is a bit harder, of course.

Lots of us have been conditioned to be "employees." That means we depend on others to provide work for us. We are not conditioned to look into what constitutes a worthwhile and potentially profitable endeavor that could become a business. Look around, there are lots of things that need doing, that are not getting done.

Some of those things could start getting done as volunteer work by the under-employed. That would both add to the resource base of the nation, and increase our human skills too. And once the activity works up enough steam, perhaps it could shift into a paying concern for all involved.

I have already many times described the potential system of home-sited educational-manufacturing workstations, and it has been ignored; but I put it out there once again, as a way to become price-competitive in the world once again.

Is there any chance that the partisan congress critters will come up with a solution for all Americans - that supposedly they represent? How about requiring each of them to take some exam, to show their individual competency for solving our nation's problems? Getting elected by the best hoo-rah cheerleaders may not be the same thing as picking competent folks to be at the decision table. So the likely happening is that it all will default into whatever power-hungry folks are pulling some strings. And with a nation with enough nukes to kill all life on the planet, do we dare let that happen? We have a responsibility to the world, even if not for our own selves. Probably what they would say is that they are boss and that is all that counts. Start another war or two, expand the ones ongoing, create more financial destitution, and the population will be too distracted to complain any more. Where has history seen such before? Supposedly America's design prevents that from happening.

President Obama seems to be doing his best as a lawyer representing the American people, but has been forced into the mode of cutting the losses. He has little power given to fix the problems, and his efforts are constantly under attack by those who are experts in attack, not experts in helpfulness. Somehow the population stares at all that as if it were some soap opera on their TV set, not real; switch channels and it will all go away.

We need to wake up a bit, do some clear headed observation of what is going on around us near and far, and get responsible. We are here as caretakers, not as predators.

Governed by a consortium of corporations

With the takeover of Kennedy's seat by the GOP yesterday in Massachusetts, and thus ending the Democrat's majority for being able to get projects done despite the phalanx of the GOP, I once again have been idly and briefly thinking: could the United States really be governed by a consortium of corporations run solely to make maximum profit for least value added? And presumably have the elected government only have the remaining function of interfacing with those that are there for "providing the common defense," in other words, merely for the civilian population to interface with the Pentagon. All else would be privatized.

Government would then no longer function to enable the projects needed for integrating the nation for wholesomeness of the entire American people, in that scenario. For example, such as the nation's transportation system's upkeep and improvement. Such activities, if they continued at all, could only be done by corporations for profit, extracting money from anybody who would want to drive or ride anywhere, extracted on the spot. Toll booths at every interstate border, maybe even at every city limit.

Healthcare would get far worse than it already is, in such a mode; even more businessmen figuring out a way to weasel in to leverage a monetary portion of all healing that went on. It is sick people that would bring in maximum business for such medical-related businessmen; it is not not well people. To make maximum profit for least value added, guess what. Even I can see the game.

New hordes of businessmen of the in-group to get easy money, the easy life, for joining in. Would that really be a way to prevent a tyrant from taking over the government someday?

This kind of scenario seems to me to maybe be the basic vision the GOP party says it promotes. And some indication that some of them believe the ends justifies the means; lots of fear synchronized in the news gets scared people to vote for the GOP, typically, instead of courageously daring to reach for a better life. Is their way the only option against some day a dictator taking over and ruling everybody for selfish purposes, absolute power corrupting absolutely? Is a horde of petty tyrants preferable to one humongous tyrant, in other words. Surely this country has better options than either of those.

Making the assumption that a country could be benevolently run by a group of corporations which are solely ruled by maximizing corporate profits to supply to their investors, maybe that could work, if somehow "maximum profit for least value added" could equate in aggregate to "maximum improvement in life quality for all Americans." Right now, there seems to me to be a very large gap between the two, needing to be bridged.

Additionally, there seems to be a continuing pattern of gamesmanship, for the purpose of making winners by making losers of the other folks. While this fits in the finest of exciting team sports activities, and thereby conditioning the mentalities of enthusiasts, American government "by the people and for the people" does not seem to me to be an appropriate place for that kind of activity. (PS BTW the new law that corporations can spend unlimited advertising and pressure for their narrow interests, as if they were an individual, suggests that the government "by the people and for the people" will soon need to be changed to read "American government by the most powerful corporations for the most powerful corporations."

The GOP has at times in the past been a fine political group that was able to accomplish great things for America. But it has too often been largely taken over by narrow interest groups that are far more for themselves than for America. And some of the current power in the GOP possibly comes from their aggregate guilty feelings about some of what they did in the eight years of the previous administration, and use the tactic of pointing the finger of blame away from themselves furiously so as to prevent having to deal with their own huge errors. Blaming is a dominant mode of some of the psychological types; blaming of others, that is. Yet the only constructive mode is to identify problem origins as problems, seek how to avoid falling into those modes again, and move on to get the job done of making America function optimally for Americans - instead of for powerful narrow interest groups that have expertise in greed, deception, smoke&mirrors and insideously spreading false information about their supposed enemies, yikes! I recently saw a circulating email where they had a long list of public works over the decades initiated by Democrats and saying they were all failures as proven by the assertion that they had not made a profit! Clearly they missed the point of it all; we are all on the same ship together, why can't they see that? Such is the philosophy they have, such tunnel special interest vision. Almost as if they function as mere predators on America and its resources. Winner take all. Making profit instead of making better, basically, seems to be their implied golden standard. Yet there surely are worthy skills among even those who practice such things; American needs to find ways to enable those fine honorable and constructive modes to shine forth in them, as in all Americans.

Ah, well, there are a huge number of things people do that seem to make little sense to me. To ponder it too much is just another crazymaker. Write a little rant in a blog that others seem to not be able to find, write it off as done. Looks like we the American population are due for more experience in getting our noses rubbed in it, to eventually learn the lesson. Surely there are more interesting and fun ways to get the daily dose of drama, to keep life from being boring. And yes, I know they did not ask me. So, what's new, as it is said.

Repairing rule by law and enforcement

The urge to write what is no doubt another Aspie viewpoint is ongoing, so here goes again.

The evolving expression of American government seems to be turning to "rule by law and enforcement", as a response to the the prior form of "rule by business feudalism anarchy" that was a carryover from an identity reaction to the Cold War era economic principle in opposition to Communism and had sought to take over the American government ever since back then and found the public weakness in the plush times that the Clinton era had achieved for America which unfortunately produced a nation of "couch potatoes."

Each such extremism expression of governmental rule has its weaknesses, and two of the ones of "rule by law & order" is the lack of padding to forgive some tolerable level of human lack of infallibility; in a system of following the rules, people find they have made mistakes and sometimes coworkers discover those mistakes and keep them stashed away as "things they have on so-and-so" to guarantee their jobs (in the case where the subordinate has "things on the boss";) the counter force to this is the stern and ruthless penalty for "talking."

The movie "It's A Mad Mad World" in its later parts portrayed the play-out of officialdom's hoarded mistakes being used to force a decision, a retirement bonus in that case; and the movie "Untouchables" portrayed the ruthless enforcement of "not talking" when the mobster had his teeth shot out one by one; and of course the meaning of "The Untouchables" itself is involved here, the small subset of law enforcement that could not be swayed by powerful political and business forces.

The other critical weakness of a system of living strictly by the rules, the published written set of "laws," is illustrated by the old wisdom that goes "there are two things you don't want to know for peace of mind, and they are the ingredients of making sausage, and the making of laws." How crippling this system can be is currently illustrated by the law against sale of the essential nutrient L-Tryptophan as a supplement, a substance required for competent mental functioning and is very hard to get in proper ratio in the American diet; and in the law against growing and using hemp, a common native plant including in America throughout history up until it was made illegal due to some irritation about the relatively recent practice of recreational use by some segments of society to temporarily escape some of the pressures of life; yet the hemp plant had been used very beneficially as a sturdy substitute for cotton and wood pulp in the manufacture of durable clothing and paper products and of course the now ridiculed use for making rope, considering the rope was widely used, such as to tie up battleships to piers during WWII, and at that time was the highest strength-to-tensile-weight material known to civilization throughout history; and all cheaply grown and utilized for construction, clothing, writing materials, and the seed an outstandingly balanced nutritional food source. One might think that banning these two example substances, L-Tryptophan and all growth of the hemp plant, would be an action by an enemy force to weaken America; but most likely was just accidental expressions of the failure weaknesses of the law-making process along with deliberate use of those weaknesses by cunning greedy business and political special interest groups; the ploys worked and still do so, sadly for the American people. Ferreting out the real ways those laws got on the books would likely expose powerful special interests to embarrassment or worse, and thus is not likely to happen, sadly. How they could continue to consider those substances, even the "psychoactive weed" part of the hemp plant itself, as worse for the American public than, say the still legal MonoSodium Glutamate, the currently widespread food-craving obesity-inducing additive that also converts to a neurotoxic substance in the body, is quite baffling to this naive Aspie: are they really on the side of the American public? How could they be, I wonder. Big business games, I suppose, preying on the people of this nation, justified by producing maximum dividends to investors, so it is therefore OK to do.

And those laws continue to remain on the books and are currently used as excuses to destroy hemp crops and imprison people, amazing; as well as blocking the inexpensive availability of L-Tryptophane to balance the nutrition needed for adequate sleep and sleep's restoration of the ability to cope with new challenges of the day, thus enabling the sale of vast quantities of expensive sleeping pills and psychiatric drugs; all making lots of money for the perpetrators, while causing incredible aggregate dysfunction to the people of this nation. The admission that they were actually wrongful laws, and that society has committed grievous injury to vast numbers of people, perhaps the entire nation in the case of L-Tryptophan, would have quite scary implications for those responsible; and they being in power, will understandably seek to prevent knowledge of the huge problem, business-as-usual continuing to triumph; whew.

Another aspect is the hordes of enforcers of the rules, ranging from the mobsters silencing squealers, to the gun-waving flame-thrower wielding assaulters of farmers growing hemp plants, possibly are a way to cope with the otherwise unruly large number of men who find their identity in abusing other men to show superiority, a reproductive strategy that has worked from very ancient times.

How to go back and clean out such weaseled-in laws, and to prevent more such wrongful laws from getting on the books, would be very hard; perhaps as difficult as the cleaning up of the proverbial sausage's ingredients; but surely ought to be done somehow, to help the American people and nation.

So employing the innately-abusive type of people as security employees and subjecting them to a life in a hierarchy that attempts to require them to live by "the rules" somewhat brings law and order to that large subset of the population, and fulfills the urges of such individuals to threaten and sometimes visibly carry out, raids on other folks; but supposedly only when the other folks have broken the "laws" somehow.

This urge to assault is also partially controlled by the experiences of teams assaulting other teams by-the-rules, with varying levels of physical bodily violence against other men's bodies required, such as in the hallowed game of football, which also enables tolerable expression of the urge to team-participation plot and act with the sole purpose of preventing success of the opponent team's goals for their success. Unfortunately these conditioned mindsets still have the permissibility to abusively relate to others and to work to prevent others' success, beyond the confines of the football field; hardly a wholesome modality, especially when the nation is struggling as she is now.

Perhaps the enlisting of those instinctively abusively violent men, and some women similarly, into careers that are tolerable to the community, by having the hired ones express their urges in preparation, and occasional carrying-out in direct abuse-by-the-rules nominally against others of their kind who are not in their "team" who have "broken the laws" and thereby are fair game to be hunted down and righteously treated abusively. Effective supervision of such endeavors looks difficult, however, to this Aspie.

Such efforts to control the rule-by-abuse through law enforcement's stalking, spying, harassing, invasion of property, eavesdropping, and finally destruction of property, cornering and imprisoning the opponent if not killing them outright, has a very long history, of course; and if they cannot dig up excuse to assault a targeted person, then by hyping themselves up, they can become so sure of the targetability of the person as to then cunningly salt evidence to frame up the targeted person, to provide excuse for the team to righteously assault.

Getting those kind of folks into teams that attempt to live by a set of rules and rewarding them with paychecks and social position power, and hope it all adequately tames them so they are "off the streets," seems a much better mode than letting them run amok as they otherwise would be doing, such as exemplified by the rein of the mobsters of the American 1920's and the reputed equivalent tragic state of affairs in such places as Ukraine in present time.

The secret system of "who has got what on whom" is apparently an inherent weakness of the form of rule by law-and-enforcement, and its very mention can be done only at grave risk (I have yet to see if I have the courage to post this as a blog entry; and yet, the high quality of America was not created in cowardice;) yet if a whole nation is to be governed that way, then it seems very wise to find some other more hospitable means for acknowledging the occasional goofs each individual makes each day despite diligent efforts to live properly, so as to not have the secret ability to threaten to proclaim the hidden collection of someone's goofs as a way to force favoritism in certain circumstances, which are likely to be similar discovery of the other's goof too. The means to differentiate this from other forms of failures to fully perform one's duties responsibly, ought to be derivable; and if achieved, hopefully would resolve that hidden undercurrent that undermines the conduct of living by the rules at all stations in the country.

Such folks would probably read this solely with an eye for how to discredit, hide and erase its implications to the public; instead of seeking its truth and seeking ways to fix the existing system's weaknesses; since those folks are caught up in their position in the social web, and that is what they do in it.

Fortunately, (or unfortunately) all this perhaps can engage the compulsive game-playing urges of such assaultive-wannabe folks; and so the wise intelligent design and implementation of new rules for the big game might be able to increasingly harmonize the system. Well, one can hope so, anyway.

Most likely no such law-and-order system can be derived that will take the place of understanding, forgiveness and loving support of all others, while this planet of life and living grows. Yet there are some emergent very inexpensive and simple ways for each individual to clear out the embossed psyche energy of abuse in oneself, along with lots of other internally disruptive energetic patterns too; for example, the "Emotional Freedom Technique or EFT" that look like they could fix much of the problem at its root cause; but they have to be adequately used to be effective; and also are unlikely to become widely used quickly enough to help the nation through the present crisis, since it would be seen as undercutting the way-things-are that is so necessary for business-as-usual that is providing such plush times for the powerful who have their identity partially in the abuse-excuse-by-the-rule's results.

In the meantime, we continue to need, as a people, to create the goods and services that are needed by us all; and need to utilize the existing business-political structures insofar as possible to get it all done as efficiently and comfortably as possible for all.
